Welcome to the RoofWorks Northwest website ("Site"). By accessing or using this Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

RoofWorks Northwest ("RoofWorks," "we," "us," or "our") is a roofing contractor serving Snohomish County, Skagit County, and surrounding areas in Washington state.

1. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

• Use the Site in any way that violates applicable federal, state, or local laws
• Submit false, misleading, or fraudulent information through any form
• Attempt to interfere with or disrupt the Site's functionality, security, or infrastructure
• Use automated tools (bots, scrapers) to access the Site without prior written permission
• Impersonate any person or entity, or misrepresent your affiliation

2. Quote Requests, Inspections, and Estimates

By submitting a contact, quote, or inspection request:

• You represent that all information provided is accurate and complete
• Submitting a request does not create a contract; any roofing services we provide are governed by a separate written contract or estimate that you sign before work begins
• Estimates are valid for the period stated on the estimate document and may be revised based on inspection findings or material price changes

3. SMS Text Messages — Program Terms

Program name and description

RoofWorks Northwest Customer Texting. By opting in, you agree to receive recurring automated SMS text messages from RoofWorks Northwest at the phone number you provide. Messages may include appointment scheduling, quote follow-ups, service updates, and — if you separately opt in — promotional offers and seasonal reminders.

Message frequency and rates

• Message and data rates may apply depending on your mobile carrier

Opt-out and help

Carrier disclosure

Carriers are not liable for any delayed or undelivered messages.

Consent

Consent to receive SMS messages is not a condition of any purchase or service. Your phone number, opt-in data, and consent will not be shared with any third parties or affiliates for any purpose. See our Privacy Policy for details on how we handle your information.

4. Email Communications

By providing your email address through any form on the Site, you may receive:

• Transactional emails related to your inquiry, quote, or scheduled service
• Marketing and update emails (only if you separately opt in)

You may unsubscribe from marketing emails at any time via the unsubscribe link in each email. Transactional emails related to active inquiries cannot be opted out of.

5. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of RoofWorks Northwest or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without written permission.

6. User-Submitted Content

By submitting content to the Site (form responses, photos, descriptions), you grant RoofWorks Northwest a non-exclusive, royalty-free license to use such content for the purpose of responding to your inquiry and providing the requested services.

7. Disclaimer of Warranties

The Site and all information on it are provided "as is" and "as available" without warranties of any kind, either express or implied. RoofWorks Northwest and its technology service provider (Memcap) disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, uninterrupted availability, security, and non-infringement. Roofing services we provide are governed by the warranty terms in your signed contract or estimate; nothing on the Site constitutes a warranty.

8. Limitation of Liability

To the fullest extent permitted by law, RoofWorks Northwest, its officers, employees, and technology partners (including Memcap) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, any errors or omissions in Site content, unauthorized access to your data, or any third-party conduct on the Site.

9. Indemnification

You agree to indemnify and hold harmless RoofWorks Northwest, its officers, employees, and technology partners from any claims, damages, or expenses (including attorney's fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

10. Technology Service Provider

This website is built and managed by Memcap ("Technology Provider") on behalf of RoofWorks Northwest.

• Memcap acts as a service provider to RoofWorks, not as a party to any transaction between you and RoofWorks. Memcap has no contractual relationship with you arising from your use of the Site.
• Memcap is not responsible for RoofWorks's roofing operations, scheduling decisions, estimates, contracts, or service delivery, and is not a guarantor of any roofing work.
• Memcap provides the Site and the underlying technology platform "as is" and "as available" and disclaims all warranties to the same extent as RoofWorks does in Section 7.
• Memcap's total liability arising from or related to your use of the Site or these Terms shall not exceed one hundred U.S. dollars ($100), regardless of the cause of action and regardless of whether the remedy fails of its essential purpose. This cap is independent of, and in addition to, the limitations in Section 8.
• Memcap is an intended third-party beneficiary of Sections 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Indemnification), and this Section 10, and may enforce those provisions directly against you.
• Memcap's handling of personal information is described in its own Privacy Policy and is governed by a separate data processing agreement between Memcap and RoofWorks Northwest.

11. Third-Party Links and Services

The Site may contain links to third-party websites and services. We are not responsible for the content, policies, or practices of any third-party sites.

12. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Snohomish County, Washington.

13. Changes to These Terms

We may modify these Terms at any time. Changes take effect when posted on this page with an updated effective date. Your continued use of the Site after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
